The importance of Vision Suite’s Terms and Conditions

The terms and conditions expressed in the terms and conditions on the Vision Suite site, are important as once accepted by a user, they form the basis of the agreement between Vision Suite and users;


Apart from the express terms and conditions, the agreement between a user and Vision Suite also includes those terms and conditions that are implied through use of online educational sites (of the same or similar types or formats as that of Vision Suite) and online sales of digital products which have developed over time and have now become common usage, a user understanding and an acceptability by users of online courses;


A breach by a user of the terms and conditions can give rise to a termination of the services offered to a user and Vision Site relies upon its absolute right to termination access to the site to a user who has breached the terms and conditions.


Copyright and all Intellectual Property

Vision Suite claims copyright and protection to its Intellectual Property: name, logo, marketing and promotional material, courses, modules, digital products, sound and other templates used or purchased online (Vision Suit copyright material)


You are granted a limited licence to use the Vision Suite copyright material while you utilise the Vision Suite online site and after you purchase and/or use online modules while you AND such licence may be revoked by Vision Suite any anytime for any reason whatsoever and once you do not use the Vision Suit online educational site, the Licence is automatically cancelled and all rights relating to the Licence to use the Vision Suite copyright material are immediately terminated.


You have no right under the agreement with Vision Suite to modify, distribute, sell, hire, lease or to share the contents of the Vision Suite copyright material.


You are also prohibited from sharing your username and password with any person for the purpose of that other person(s) gaining access to the Vision Suite copyright material.

VISION SUITE makes every effort to ensure that all the information and content on our website and in our modules, module materials, digital products, sound design templates are accurate and kept up to date.


VISION SUITE does not guarantee the accuracy, reliability or currency of the materials or information we provide.


VISION SUITE gives no warranty, makes no representation, nor gives any undertaking, whether express or implied nor do we assume any liability, whether direct or indirect, nor responsibility for the accuracy, completeness or usefulness of any information, content, course materials, digital products, sound design templates provided by us.


The course materials, and information provided by VISION SUITE does not purport to constitute professional advice. VISION SUITE accepts no responsibility for and makes no representations, whether express or implied, as to the accuracy or reliability in any respect of any course material, course or information provided by us.


Except to the extent provided by legislation, we do not accept responsibility for the consequences of or any reliance that any person may place on any course material, course, digital products, sound design templates or information supplied by VISION SUITE. 


VISION SUITE will not be liable to you or any other person for any loss, damage (including direct, consequential, economic loss or damage) costs and expenses however caused and whether by negligence or otherwise, which may result directly or indirectly from the use of course material, or information or a course or digital products or sound design templates provided by VISION SUITE.


Acknowledgment Release and Waiver 

You acknowledge and agree that upon participating in any course offered by VISION SUITE, you first acknowledge and agree to the terms of the disclaimer set out above.


You further acknowledge that any course offered by VISION SUITE will not lead to any formal accreditation, certification or qualification and may not be recognised as prior learning with respect to any other accreditation, certification, or qualification.


You waive any right to make any claim against VISION SUITE or any of its directors, officeholders, employees or contractors in respect of any information, course or course materials or digital products or sound design templates that may be provided to you or upon which you may otherwise have relied. 


You agree not to commence any proceedings or take any action to enforce or maintain any claim against VISION SUITE or any of its directors, officeholders, employees, and contractors arising out of the use, purchase, hire of any of Vision Suite online information or material or digital products.


You agree to indemnify VISION SUITE and each of its directors, officeholders, employees, and contractors against any liability, loss or costs arising from any breach by you of this agreement.


Claim means any claim, action, proceeding or entitlement, whether past, present or future, whether known or unknown, which you or any other person has or might have under or arising out of or in any way connected to a contract or other arrangement with us.



Sales/Marketing Initiative Terms & Conditions:

Fees and Charges  

By enrolling in the course, you agree to pay the course fees (plus applicable surcharges) using the payment method you have selected under the course enrolment agreement. 

You are required to pay the total amount of the course fees even if you do not complete your course.

User fees will include the necessary e-learning resources such as online interactive resources, online PDFs or workbooks dependent upon the course of study chosen. 


Money-Back Guarantee Period

If you are not satisfied in anyway with the course or course material, Vision Suite will refund the fees paid PROVIDED that you notify Vision Suite of your dissatisfaction and your wish to cancel your enrolment, within 7 days of enrolling and paying the relevant fees AND are within the specific Terms & Conditions agreed upon for the specific course you are wishing to refund.


Course commencement 

Unless otherwise agreed, the course commencement date will be within 24 hours of receiving the payment. The user will be admitted to the course once the payment is received, provided they have already created an account on visionsuite.co.


Course Changes and Updates

VISION SUITE is dedicated to providing users with the most current and relevant information. Therefore, we may periodically update, change, or amend our modules to ensure they remain up-to-date and aligned with industry standards.


User Conduct

Respectful and professional conduct towards those working for or engaged by Vision Suite is essential. We are committed to addressing and resolving any issues you may encounter; however, any form of abuse towards our team members will not be tolerated. In cases of abusive behaviour, we reserve the right to cancel your course enrolment and remove you from the training platform.


Refund and Cancellation Policy

Vision Suite will consider a refund, in whole or in part, of fees and charges paid ONLY if:

(a)  VISION SUITE cancels the nominated course before you have logged in to access the system;


(b)  You, the user, decides to cancel within the 7-day money-back guarantee period.


(c) The request is made in accordance with the specific terms and conditions applicable to the course for which the customer is enrolled and wishing to refund.

 

Conditions Precedent to a Refund:

(a)  Any refund granted is subject to a deduction for processing fees incurred by Vision Suite.

 

(b) If you have used a student loan, loan service, or third-party financing to fund the course fees, you will be responsible for covering all associated processing fees, including any additional late or failed payment fees charged by the provider.

 

(c)   Refunds will not be made, under any circumstances, outside of the 7-day money-back guarantee period.

 

(d)  Any refund granted is subject to the specific Terms & Conditions of the course for which you are applying to refund. (e) A request for a refund must be submitted in writing within seven (7) days of the customer registering for the course with Visionsuite.


(f) Refunds will not be granted to any customer who has downloaded or accessed any of Mike Snell’s premium mixing and mastering templates included in the course.


(g) Refunds will not be granted to any customer who has scheduled or attended the one-on-one session with Mike Snell as part of the course offering. (h) Refunds will not be issued to any customer who has accessed or completed more than seventeen percent (17%) of the course content.



 

Obligation on User:

 If the user/customer does not honour the payment and VISION SUITE T&C’s cancellation process, VISION SUITE will remove access to the user/customer course and follow the standard cancellation process; failure to pay might result in debt recovery action being commenced by Vision Suite against you for the default in payment of fees.


Course Expiry and Access

You can continue to access your course online, permitting:

  • the course remains active on our website

  • the course is owned by VISION SUITE 

  • the course is not currently being reviewed or improved

  • You have paid your account in full.

User/Customer Consent:

VISION SUITE acknowledges they must obtain customer consent via a deduction authority before a direct debit can start, increase or restart. For any customer queries, please reference contact@visionsuite.co


Unlimited Access

Unlimited access means that your access does not expire. The only exception to "unlimited access" is if the course is cancelled.

You can return to complete the course at any time, permitting your course access is current (see above in Course Access and Expiry); your Unlimited Course Access is unlimited.

Complaints

VISION SUITE has a fair and equitable process for dealing with user complaints.

VISION SUITE has a two-tiered approach to complaints:

  • Informal complaints

  • Formal complaints

If you have a complaint about anything related to your course, you should first try to resolve the problem through reaching out in the dedicated course group. However, if you feel that you cannot do this or if your complaint or concern is about something that is not directly related to your course, you may contact Support Services; contact@visionsuite.co


Collection and Use of Personal Information

VISION SUITE collects and uses personal information for the following purposes: 


  • Provide information about you to VISION SUITE's network of industry partners and contractors (consultants or contracted third parties, including mentors and employers) to assist you, effectively manage your progress, and support your individual needs (all third parties will abide by this Privacy Policy and the Australian Privacy Principles)

  • Provide information, products, and services to you and request information to manage and administer those products and services (including enrollment, assessment, and issuing certificates).

  • Respond to your queries relating to the VISION SUITE website, its products, advice and services

  • To better understand your needs and help us to improve our products and services.

  • Internal record keeping

  • Circulation of promotional emails about new products and services, special offers or other information that we think you may find interesting (you may opt out at any time)

  • Contact you for market research or direct marketing purposes (you may opt-out at any time)

  • Customise the website according to your interests and needs, and

  • Customise documents according to your business needs.

VISION SUITE may contact you using a variety of measures, including by telephone, email, SMS or mail. All communications from VISION SUITE will be via your contact details, which are recorded on file. You may also engage with VISION SUITE via email & various social media platforms, which collect and store your personal information and data. It is your responsibility to keep your details up to date. You may update your contact details or preferred method of communication, unsubscribe, or opt out of any marketing communications by contacting VISION SUITE at any time.

Disclosure of Personal Information     

VISION SUITE may disclose your personal information under the following circumstances:

  • Providing third parties (including employers and mentors) - as nominated by you with information about your progress


  • Providing information, products, and services to clients


  • To register and administer events, promotions, or competitions


  • To verify personal information details upon request from third parties, such as completion of courses, a request from a potential employer verifying a qualification and further enrolment into another institution


  • In the case of students under 18 years of age: Information regarding attendance, progress and general well-being may be provided to keep parent(s) and guardian(s) adequately informed


  • To credit reporting agencies and courts, tribunals, and regulatory authorities where users fail to pay for goods or services we provide.


  • To courts, tribunals, regulatory authorities, and law enforcement officers as required by law, in connection with any actual or prospective legal proceedings, or to establish, exercise or defend our legal rights.


  • To one or more Consultants, with your consent, to provide information and services to you


  • To the relevant third party or parties, with our client's consent, if the matter involves third parties; and


  • To third parties, including agents, referral partners, contractors and sub-contractors, to provide you with information, products and services. This may include parties Vision Suite or storing data outside of Australia. All third parties will abide by this Privacy Policy, the Australian VET Data Policy, and the Australian Privacy Principles.


  • Suppose there is a change of control of the VISION SUITE business, sale, or transfer of business assets. In that case, we reserve the right to transfer, to the extent permissible by law, VISION SUITE user databases and any personal and non-personal information contained in those databases. This information may be disclosed to a potential purchaser. VISION SUITE would seek only to disclose information in good faith and where we have sought to maintain confidentiality. 

VISION SUITE does not typically or routinely disclose personal information to overseas recipients unless the overseas recipient is a contracted third party acting on behalf of the organisation or an exception under the Australian Privacy Principles applies. VISION SUITE will only disclose personal information to overseas recipients where reasonable steps have been taken to ensure the overseas recipient does not breach the VISION SUITE Privacy Policy or the Australian Privacy Principles.
